Questar III’s hearing officer service offers two distinct hearing options for school districts to access: student disciplinary and Civil Service, section 75 hearings.

Student Disciplinary Hearing Officer: provides subscribing districts with a hearing officer for a student disciplinary hearing. Certain disciplinary actions cannot be taken under law without providing the student and his or her parents/guardians the opportunity for a fair hearing before the superintendent. The superintendent may choose to employ a hearing officer. The officer would hold the hearing, create the record of the hearing and make a written recommendation of findings and penalty to the superintendent.

Civil Service Law, section 75 Hearing Officer: provides subscribing districts with a hearing officer to hold an employee disciplinary hearing under section 75 of the Civil Service Law, which states that certain non-instructional employees may not be disciplined or terminated without a fair hearing. This service includes holding the hearing, and preparing a written recommendation for disciplinary action to the district.

Cost Methodology

Section 75 Hearings: The rate consists of a per diem rate for the hearing and an additional hourly rate for preparation of the written recommendation.
